E-3 Visas
In May 2005, a new NIV category was created for citizens of Australia. The Act provides for 10,500 new visas per year for Australian nationals seeking temporary work in specialty occupations. It is important to note that Australian nationals who apply for a new E-3 visa while remaining with the same employer are not included in the “cap”. As of March 2006, U.S. consular posts in Australia had issued a total of nearly 500 E-3 visas. To qualify for an E-3, an Australian national must be: (1) sponsored by a U.S. employer who has obtained an approved Labor Condition Application (LCA) from U.S. Department of Labor (DOL) attesting to the applicant’s salary and work conditions; (2) entering the United States temporarily to work for a U.S. employer in a “specialty occupation” defined by law as one requiring theoretical and practical application of knowledge in a professional field and attainment of a bachelor’s degree, or its equivalent, as a minimum for entry into occupation in the United States; and (3) possess relevant educational degree and evaluation verifying its equivalency to U.S. degree. Although the E-3 Visa is renewable indefinitely in two-year increments, the applicant must have no intent to remain permanently in the United States. Unlike an H-1B, after the spouse of an E-3 visa holder enters United States, he or she may apply for Employment Authorization Document (EAD).

CHINA

As the burden of proof is on the clients to demonstrate that no disqualifying periods of unlawful presence were accrued during prior visits to the United States, care must be taken to over-document to prove there was no period of unlawful presence which would subject the client to the three- and ten-year bar to readmission to the United States. IT may be particularly problematical when one departure the United States when an application for extension of status is pending.

Officially, Frankfurt has jurisdiction for all applicants from the following states: Baden-Württemberg, Hessen, North Rhine-Westphalia, Rhineland-Pfalz, and Saarland, as well as nonresident TCNs. Berlin has jurisdiction over the states of Berlin, Brandenburg, Bremen, Hamburg, Mecklenburg-Vorpommern, Niedersachsen (Lower Saxony), Saxony, Saxony-Anhalt, Schleswig-Holstein, and Thuringia, and will also process some nonresident TCNs. Munich’s consular district will be limited to Bavaria. In a new and welcome significant change, however, posts and the call center have been clearly instructed to allow German nationals to apply at a post of their choosing.

INDIA

U.S. Consulate: Chennai (a/k/a Madras)
The consulate general serves the States of Tamil Nadu, Andhra Pradesh, Karnataka, Kerala, the Union Territories of Pondicherry, and the Ladshadweep Islands. The Department of State (DOS) recently announced that it will be opening of a U.S. Consulate General in Hyderabad; however, little information is currently available as to when it will open and what its specific visa application procedures will be. Given Southern India’s prominence within the IT industry and other fields, many companies in the region are the subsidiaries or affiliates of major U.S. companies and, accordingly, the Chennai consulate processes a very high volume of blanket L-1 visa applications. In September 2005, following with many of the statutory changes from earlier in the year restricting usage of the Blanket L-1 visa, the consulate announced a number of new policies which have made it more difficult for many applicants to qualify for blanket L visas, particularly in the L-1B specialized knowledge category.

The fastest way to get an appointment is to complete the electronic visa application (EVAF) Form DS-156, online, available in the Visa Application Forms section of the consular section’s website. Make sure that applicants use the barcode version for fastest processing. The USCIS office in Rome also processes I-601 IV waivers for misrepresentation, INA §212(a)(9)(B) and criminal issues. NIV waiver applications are filed with the consular post and processed by Admissibility Review Office (ARO) of U.S. Customs and Border Protection (CBP) in Minneapolis, Minnesota. Expect at least one month for processing of NIV waivers, although consular officers can request expeditious processing.
